DENVER–A legislative committee on Tuesday advanced a bipartisan bill aimed at increasing criminal penalties for stealing guns in Colorado, just one year after a similar effort failed in the statehouse.
House Bill 25-1062 makes theft of a firearm a class-6 felony, which carries a maximum sentence of 18 months imprisonment, regardless of the value of the gun stolen. Currently, the penalty for gun theft is based on the value of the firearm, and can be as low as a petty offense if the value is less $300. A stolen gun must currently be worth over $2000 to be considered a felony.
According to the bill summary, subsequent violations, including “multiple firearms stolen in the same criminal incident” would become a class-5 felony, which carries a maximum 3-year sentence.
The effort enjoys bipartisan support, with Republican Ryan Armagost of Berthoud and Democrat Monica Duran of Wheat Ridge sponsoring the bill in the House, and Nick Hinrichson, a Democrat from Pueblo as the lone Senate sponsor. The bill passed the Democrat-controlled House Judiciary Committee on Tuesday by a narrow 6-5 margin.
A similar attempt at increasing penalties for gun theft in 2024, also sponsored by Armagost, failed in the same committee.
The bill now moves on to the House Appropriations Committee.
