DENVER–Members of the U.S. House Judiciary Committee, along with a member of the Colorado congressional delegation, are demanding information from local authorities in Denver and Boulder on sanctuary policies the lawmakers say help shield criminal illegal aliens from deportation.
House Judiciary Committee Chairman Jim Jordan (R-OH), Immigration Subcommittee Chairman Tom McClintock (R-CA), and Rep. Gabe Evans (R-CO) on Tuesday directed letters to Denver District Attorney John Walsh, Denver Sheriff Elias Diggins, and Denver Police Chief Ron Thomas. Jordan and McClintock also sent separate letters to Boulder County District Attorney Michael Dougherty, Boulder County Sheriff Curtis Johnson, and Boulder Police Chief Stephen Redfearn.
Evans is not a member of the Judiciary Committee, but his 8th Congressional District includes portions of the north Denver metro area.
Evans told Complete Colorado he signed on to the letters due to policies in Colorado that “protect criminals, limit law enforcement and have diminished public safety.”
The letters cite specific incidents in which Denver and Boulder officials declined to cooperate with Immigration and Customs Enforcement (ICE) detainer requests, with consequences that the members of Congress call both predictable and preventable.
“Denver’s homicide rate is up 50% compared to this time in 2025, and despite our state making up 2% of the country’s population, 10% of all human trafficking happens here,” said Evans, calling the statistics a direct consequence of sanctuary state laws supported by Democrats. “That’s why I joined with Judiciary Chairman Jim Jordan to demand answers and data from soft on crime officials.”
In one documented case, the Denver Sheriff’s Department released Abraham Smith Gonzalez — a suspected Tren de Aragua gang member previously charged with aggravated assault, motor vehicle theft, and felony menacing — rather than honor an ICE detainer. When ICE agents subsequently attempted to arrest Gonzalez outside the jail, he assaulted one of the agents. The committee notes the arrest could have occurred in a controlled setting had the detainer been honored.
ICE has warned that three additional criminal aliens are currently at-large in the Denver area after local law enforcement declined to honor detainers. The three had previously been arrested on charges including child abuse, assault with a weapon, burglary, cocaine distribution, and failure to appear.
The Boulder County District Attorney’s office drew particular scrutiny. According to the committee, DA Michael Dougherty’s office not only prohibits information sharing with ICE, but has acknowledged willingness to reschedule court dates when defendants fear immigration enforcement, among other accusations.
Dougherty is also a Democrat candidate for Colorado attorney general, competing for a shot at the office in the June 30 primary election.
